Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By using the site, you agree to these terms of use. If you do not agree, do not use the site or any of the products and services offered via the site. By accessing this site and/or any of the products offered via this site you agree to all of the terms and conditions set forth below.
Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
As part of my agreement to the terms of services, I, the parent/guardian of the participant/student acknowledge the following:
- Acknowledge that my child’s participation is completely voluntary.
- Understand the potential physical risks involved in basketball training and believe that the potential benefits outweigh those risks.
- Give consent to certain physical touching that may be necessary to ensure proper technique and body alignment.
- Understand that the achievement of my child’s basketball skill goals cannot be guaranteed.
- is welcome to ask questions regarding any concerns I might have.
- Agrees my child has no impairment which might prevent him/her from participating in such activities.
- Agrees to cease exercise immediately if my child experiences unusual discomfort and feels the need to stop.
Assumption of Risks
I understand that no exercise program is without inherent risks and, regardless of the care taken by the personal trainer, he or she cannot guarantee my child’s personal safety. For example, when one induces cardiovascular stress through activity, injuries can range from occasional minor injury (e.g., pulled muscles, muscle soreness) to infrequent serious injury (e.g., heart attack, stroke, or other cardiovascular accidents) to the very rare catastrophic incident (e.g., death, paralysis). Likewise, I know that engaging in muscular endurance, strength building, and other fitness activities occasionally result in minor injuries (e.g., bruises, musculoskeletal strains, and sprains), infrequently, more serious injuries (e.g., muscle tears, herniated disks, torn rotator cuffs), and very rarely, catastrophic injury (e.g., death, paralysis).
I realize that when participating in any exercise or conditioning activity, there is always a possibility that minor injuries, major injuries, or catastrophic injury/death may occur.
I understand the potential risks involved in this basketball training program. I hereby consent to those risks and am freely and voluntarily participating in this program.
Waiver of Liability
By enrolling, I ensure that my child is physically and mentally able to participate in all training activities and has been examined by a licensed medical physician within one (1) year prior to attending these training sessions. I am aware that participation in any of Will-One Basketball Academy training has some inherent risks and injury can occur. On rare occasions, these injuries can be serious. I understand that WIIl-One Basketball Academy or employees, representatives, independent contractors working for or in partnership with Will-One Basketball Academy, or the property where the session is held and any or all of its officials cannot be held responsible in whole or in part for any accidents, illness or injuries resulting in medical or dental expenses incurred from participation in this program. I hereby release each of them from and against any and all claims, costs, liabilities, and injuries incurred while in training.
I agree to assume full and complete responsibility for any and all medical bills arising from my child’s participation. In the event of any emergency, I authorize Will-One Basketball Academy to exercise its judgment in the treatment of said child by a medical authority. I also authorized the use of pictures of my child to be posted on the Will-One Sports Academy website or advertising media published by Will-One Basketball Academy. By proceeding, I acknowledge that I have read and fully understand and agree to all of its terms.
Waiver of Liability Relating to Coronavirus/Covid-19
The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.
By proceeding, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child may be exposed to or infected by COVID-19 by attending any Will-One Basketball Academy activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself, my child, my family and members of my household. I understand that the risk of becoming exposed to or infected by COVID19 at the training may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Will-One Basketball Academy employees, other students, vendors or affiliates, and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that my child may experience or incur in connection with my attendance at Will-One Basketball training. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Will-One Basketball Academy, its employees, agents, and representatives, of and from any and all claims. This includes all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Will-One Basketball Academy, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Will-One Basketball Academy services.
I DO NOT HOLD Will-One Basketball Academy and its members accountable for any accidents or the spread of COVID-19 that may occur as a result of participation in the training. My child is physically qualified to attend the training.
Training Packages
The cost of packages is determined by the total number of sessions. Each package includes specific features and weekly sessions. Weekly sessions are listed on packages as recommendations, not as a requirement. Once a package is purchased, it must be completed within 12 months. Unused sessions will be forfeited after the 12 months period has ended.
Group Packages
Group packages must be completed within a five-week period, commencing from the initial session. There is one session per week, with an extra week allocated for any missed sessions. Failure to complete a group package outside of this five-week period will result in forfeiture, with no refunds issued.
FREE Sessions
Our Free Basketball Training is a 30-minute evaluation session included with our WARM-UP Packages, If opted for. To access this session, the purchase of our WARM-UP package or any of our one-on-one packages is required. If you choose not to proceed with the package, a refund will be provided.
Weekly Sessions
Each package includes a weekly session(s) recommendation. For each of our packages, we calculated the number of weekly sessions necessary for our participant(s) to adequately improve based on the total amount of sessions in the package.
You have the option to participate in more or less of the recommended weekly sessions. To participate in additional weekly sessions, participant(s) must be 12 & older.
Bookings/Scheduling
You may schedule sessions up to 4 weeks or 2 hours in advanced. Additional weeks will become available at the beginning of the each week. Through our booking portal, you will have access to different locations and time throughout the week(end) to book sessions.
Traveling Fees
Trainers are available to travel to your location, however, there’s a small fee associated with each specific city which has to be paid per session. Our traveling fees will be available through our booking portal prior to booking sessions. our small traveling fees are non-negotiable!
Cancellation
I acknowledge that all cancellations and rescheduling of any session must be completed at least 1 hour and half prior to the session appointment time. In the event that I fail to accomplish this, the session will be forfeited. If a trainer fails to accomplish this, I understand an additional session will be added to my package for the inconvenience.
Refunds
Termination of Service
Throughout training sessions, my child (participant/Student) will be pushed and asked to give his or her best effort. If my child continues to demonstrate a lack of effort, he or she will be temporarily sidelined and dismissed for the remainder of the training. As we believe this is counterproductive and disruptive to the instructor, and fellow training-mates who are putting forth their best effort. If my child’s behavior persists, he or she may be dismissed indefinitely.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Participation Agreement
It is mandatory for children 8 and over to sign our participation agreement. Therefore, I understand that my child and I must sign the Will-One Basketball Academy participation agreement in order to participate. The document must be hand-signed and returned electronically to contact@willonebasketball.com or in person before the first training session. Failing to do so within 15 business days is an automatic cancellation and refund.
Referral Program (Parents)
We reward our participating parents 10% credit on their referrals purchase. Credits are granted upon completion of each package (all sessions must be completed). Once the package has been completed, you will have the option of using the credit for your next purchase or increasing your credits with more referrals. To receive credit, be sure anyone referred by you add your full name during their application process. As we hold no responsibility whatsoever for any incorrect name.
Affiliate Program
Our affiliate program is free to join. To start, you will need your first and last name, email, phone, date of birth, PayPal account email, and a valid photo ID. You don’t need to be an existing Will-One Basketball Academy client to start referring clients to us. You may refer anyone interested in basketball training. Our training programs are available to athletes age 6 and up, including parents/Guardians pursuing basketball training or mentorship for their children. There are no limits on how much you can make. The more referrals that convert through your affiliate code, the more you’ll earn.
It is important to tell anyone who joins through your referral to include your affiliate code during their initial sign-up process so we will recognize their referral as yours. Under no circumstances will you be eligible to receive payment on behalf of a client if your affiliate code is not attached to their name. Self-referrals are not allowed! Special promotions and discounts could be available to active members of our referral program.
We pay a 10% commission or up to $65 one-time payment, depending on the program. we pay commissions upon completion of the package (all sessions must be completed) and within 15-20 days after the verification of the package completion. You must exceed the minimum threshold of $50 to receive payment. All commissions will be sent to the PayPal account you provided when signing up. Be sure to provide the correct email address to your PayPal. As we hold no responsibility whatsoever for any incorrect email address in our file. Lastly, you are responsible for reporting your earnings to the IRS.
The process to start referring and receiving payments will go as follows:
- Apply
- Valid photo ID
- Accepted/Deny
- Unique Referral Code
- Notification when someone uses your code to purchase a training package.
- Package completion verification email
- Funding to your PayPal account within 15-20 days (via your provided PayPal email)
Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Will-One Basketball Academy and its licensors.
Links To Other Web Sites
Our Service may contain links to third-party websites or services that are not owned or controlled by Will-One Basketball Academy.
The Services may contain links to other Internet sites, resources and/or sponsors of the Services. We do not verify, warrant, endorse, or take responsibility for the availability, accuracy, completeness or quality of the content contained in these outside sites or resources. Providing links to outside sites does not constitute our approval of the content, policies or practices of those other sites. Be sure to review the terms of use and privacy policies posted on the outside sites or resources after utilizing them.
Will-One Basketball Academy has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Will-One Basketball Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
Will-One Basketball Academy reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use or any of the Products and Services offered via this Site, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes shall be deemed to constitute your acceptance of and agreement to all such changes.
