Terms and Conditions (Summer Camp)

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the willonebasketball.com (the “Service”) operated by Will-One Basketball Academy (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By using the site, you agree to these terms of use. If you do not agree, do not use the site or any of the products and services offered via the site. By accessing this site and/or any of the products offered via this site you agree to all of the terms and conditions set forth below.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

As part of my agreement to the terms of services, I, the parent/guardian of the participant/student acknowledge the following:

Assumption of  Risks

I understand that no exercise program is without inherent risks and, regardless of the care taken by the personal trainer, he or she cannot guarantee my child’s personal safety. For example, when one induces cardiovascular stress through activity, injuries can range from occasional minor injury (e.g., pulled muscles, muscle soreness) to infrequent serious injury (e.g., heart attack, stroke, or other cardiovascular accidents) to the very rare catastrophic incident (e.g., death, paralysis). Likewise, I know that engaging in muscular endurance, strength building, and other fitness activities occasionally result in minor injuries (e.g., bruises, musculoskeletal strains, and sprains), infrequently, more serious injuries (e.g., muscle tears, herniated disks, torn rotator cuffs), and very rarely, catastrophic injury (e.g., death, paralysis).

I realize that when participating in any exercise or conditioning activity, there is always a possibility that minor injuries, major injuries, or catastrophic injury/death may occur.

I understand the potential risks involved in this basketball training program. I hereby consent to those risks and am freely and voluntarily participating in this program.

Waiver of Liability

By enrolling, I ensure that my child is physically and mentally able to participate in all training activities and has been examined by a licensed medical physician within one (1) year prior to attending these training sessions. I am aware that participation in any of Will-One Basketball Academy training has some inherent risks and injury can occur. On rare occasions, these injuries can be serious.  I understand that WIIl-One Basketball Academy or employees, representatives, independent contractors working for or in partnership with Will-One Basketball Academy, or the property where the session is held and any or all of its officials cannot be held responsible in whole or in part for any accidents, illness or injuries resulting in medical or dental expenses incurred from participation in this program. I hereby release each of them from and against any and all claims, costs, liabilities, and injuries incurred while in training.

I agree to assume full and complete responsibility for any and all medical bills arising from my child’s participation. In the event of any emergency, I authorize Will-One Basketball Academy to exercise its judgment in the treatment of said child by a medical authority. I also authorized the use of pictures of my child to be posted on the Will-One Basketball Academy website or advertising media published by Will-One Basketball Academy. By proceeding, I acknowledge that I have read and fully understand and agree to all of its terms.

Waiver of Liability Relating to Coronavirus/Covid-19

The novel Coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. 

By proceeding, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child may be exposed to or infected by COVID-19 by attending any Will-One Basketball Academy activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death to myself, my child, my family and members of my household. I understand that the risk of becoming exposed to or infected by COVID19 at the training may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Will-One Basketball Academy employees, other students, vendors or affiliates, and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that my child may experience or incur in connection with my attendance at Will-One Basketball training. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Will-One Basketball Academy, its employees, agents, and representatives, of and from any and all claims. This includes all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Will-One Basketball Academy, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Will-One Basketball Academy services. 

I DO NOT HOLD Will-One Basketball Academy and its members accountable for any accidents or the spread of COVID-19 that may occur as a result of participation in the training. My child is physically qualified to attend the training.

 

Basketball Summer Camp

Any adjustments to the schedule will be done by the Camp Coordinator. It is the responsibility of the team coaches to see that their team does not waste time going on or leaving the playing area. The 4 minute subbing is not a time-out. Players are to switch out without delay. It is the coach’s responsibility to ensure that players know when they are going in. Taking excessive time when subbing will result in a warning or technical foul. Only coaches, officials, and scorekeepers are allowed on the benches, score table, and playing area. Camp sessions are to be postponed only in cases of extreme emergency.

PROFANITY IS PROHIBITED AND WILL NOT BE TOLERATED!

This includes any unnecessary verbal abuse during Will-One Basketball Academy Summer Camp directed to a player, coach, manager, spectator, and patron of the facility.

Players are prohibited from wearing jewelry during gameplay (including hair beads, hard plastic, and metal barrettes), it is a safety hazard. No tape is allowed over any jewelry. All jerseys must be tucked in and fingernails must be kept trimmed.

EMERGENCY PROCEDURES 

The following are the emergency procedures that are to be followed if a child is injured at a game or practice: Assess the problem, the accident scene and if needed, send for help. 911 will be called if necessary. Establish supervision and control for the uninvolved group participants. Have players remain on the bench. Notify parents or emergency contact person of the injured child. The camp administrator will complete an accident report. If a player is injured on the court and the game is stopped or the coach steps out onto the court, that player must sit out until the next dead ball. 

ATHLETE CONDUCT

There is absolutely no fighting! Any player who fights will be suspended for two camp sessions and if happened again, the player will be suspended for a period of one year from the date of suspension. When a player is suspended or ejected from a league/game, that person is NOT permitted to be in the playing area (gymnasium) for the duration of the suspension/ejection. If that player does not vacate the premises in a timely manner or attempts to re-enter the playing area, officials/staff can award the opposing team with a win via forfeit. Any team player or coach who can be ejected from a game will not be allowed to participate in the next league game. There will be no refund given for the suspension and/or dismissals from the camp.

Any matter not covered by the Camp shall be left to the camp administrator and game officials. During foul shots, any type of unnecessary noise from the opposing team’s bench or anyone in the stands will result in a penalty and the player will get another shot if missed. This is at the discretion of the Camp administrator.

Any changes to the current rules and regulations will go into effect the following season unless otherwise deemed necessary by the camp administrator. All non-emergency, game-related concerns will be addressed with an appointment or by phone. All decisions regarding disciplinary action will take effect immediately. All decisions by staff will be final. *All rules contained herein are subject to change.

Participation Agreement

It is mandatory for all participants and parents to sign our participation agreement. Therefore, I understand that my child and I must sign the Will-One Basketball Academy participation agreement in order to participate in the summer camp. The document must be signed and returned electronically to contact@willonebasketball.com or in person before the first training session.

Behavior/Agreement Termination

During Camp, my child will be pushed and asked to give his or her best effort. If my child continues to demonstrate a lack of effort, he or she will be temporarily sidelined and dismissed for the remainder of the camp session. As we believe this is counterproductive and disruptive to the instructor, and fellow camp-mates who are putting forth their best effort. If my child’s behavior persists, he or she may be dismissed indefinitely.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

Refunds

I understand that once I have paid for any services provided by Will-One Basketball Academy, no refunds shall be issued except during the specified periods outlined in this policy. In the event that an athlete fails to show up for Camp’s Skills training and Team practice, he or she will only be permitted to play in one-quarter of the game competition for the camp session. I understand I must request a refund prior to attending the first camp session otherwise there will be no refund issued.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Will-One Basketball Academy and its licensors.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by Will-One Basketball Academy.

The Services may contain links to other Internet sites, resources and/or sponsors of the Services. We do not verify, warrant, endorse, or take responsibility for the availability, accuracy, completeness or quality of the content contained in these outside sites or resources. Providing links to outside sites does not constitute our approval of the content, policies or practices of those other sites. Be sure to review the terms of use and privacy policies posted on the outside sites or resources after utilizing them.

Will-One Basketball Academy has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Will-One Basketball Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

 

Will-One Basketball Academy reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use or any of the Products and Services offered via this Site, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes shall be deemed to constitute your acceptance of and agreement to all such changes.
